BOISE, ID — (05-05-25) — What’s Happening: The city of Boise will soon vote on designating the LGBT flag and the Donate Life flag as official city flags — a move aimed at bringing the city into compliance with a state law passed earlier this year. For the past month, Boise Mayor Lauren McLean has openly defied the new law, House Bill 96 (HB 96), by refusing to take down the LGBT flag, which the law prohibits. She has also continued flying the Donate Life flag, which promotes organ donation.

Digging Deeper: HB 96 permits only official city flags to be flown on government property. By officially adopting these two flags, McLean and the Boise City Council appear to have found a legal workaround to avoid penalties for noncompliance.

The bigger question now is whether state lawmakers will respond by amending the law or adding penalties to prevent such workarounds.

The city council is scheduled to vote on the resolution this Tuesday.
