WASHINGTON, D.C. — (October 22, 2025) — Government watchdog American Oversight has filed a series of explosive Freedom of Information Act (FOIA) requests aimed at uncovering whether the Trump administration is planning to deploy military personnel or immigration enforcement officials to U.S. polling places during the upcoming 2026 midterm elections.

The organization submitted FOIA requests to U.S. Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection (CBP), the National Guard Bureau (NGB), and the Department of Justice’s Office of Legal Counsel (OLC). The filings seek records, directives, or legal analyses detailing any plans that could authorize federal personnel at polling locations—a move many experts warn could intimidate voters and suppress turnout.

The probe follows a recent pattern of National Guard deployments ordered by President Trump in several U.S. cities. Civil rights groups and election watchdogs now fear those same tactics could extend to the ballot box next year. Trump made similar threats before the 2020 election, boasting that he would send “law enforcement” to monitor polls — a move legal experts said risked violating federal election and civil rights laws.

“The presence of law enforcement or military personnel at polling places risks chilling voter participation and undermining public confidence in the integrity of our elections — perhaps that is what President Trump is counting on,” said Chioma Chukwu, Executive Director of American Oversight. “The possibility that this kind of government power might be used to threaten voters exercising their constitutional rights demands scrutiny.”

This investigation adds to mounting concerns about Trump’s use of federal power for political purposes ahead of 2026. He has reportedly pressured multiple states — including Texas, Missouri, and North Carolina — to redraw congressional maps before the midterms, a move analysts say is designed to lock in additional Republican seats.

At the same time, the Department of Justice has launched inquiries into ActBlue, the primary online fundraising platform for Democrats, while leaving its GOP counterpart, WinRed, untouched. The administration has also demanded detailed voter registration data from several Democratic-led states, threatening legal action against those refusing to comply.

Trump has further signaled plans to sign an executive order banning voting machines and mail-in ballots, despite prior court rulings rejecting such efforts as unconstitutional.

“Rather than stoke fear and political intimidation, this administration should strengthen trust in our democracy and address the real crises affecting people’s lives,” added Chukwu.

With the 2026 midterms fast approaching, American Oversight says its investigation is essential to ensuring transparency and accountability in a political climate increasingly hostile to democratic norms.

“Deploying military personnel or immigration enforcement to polling places would represent a dangerous escalation,” the organization noted in its release. “The American people have a right to know whether their government intends to use fear to influence the vote.”
