AUSTIN, TX — (July 24, 2025) — Two controversial bills targeting sex toy access in Texas — one banning sales in big box stores, the other enforcing online age checks — have officially failed in the state legislature.

House Bill 1549 sought to ban the sale of sex toys in major retailers like Walmart and Target. Senate Bill 3003, introduced by far-right state Sen. Angela Paxton, would have required strict age verification to purchase sex toys online. Both bills were heavily criticized by sexual health advocates and free speech groups.
Texas already bans owning more than six so-called “obscene devices,” a remnant of archaic morality laws. These new proposals were viewed as a renewed culture war attack on sexual wellness and LGBTQ+ access to pleasure products.
Sen. Paxton, recently in headlines for filing for divorce from Texas Attorney General Ken Paxton, was also the sponsor of SB 3003. Her husband, meanwhile, defended HB 1181 — the state’s controversial age verification law targeting adult websites — all the way to the U.S. Supreme Court.
That bill was upheld, but the Free Speech Coalition’s legal challenge remains active in lower courts on First Amendment grounds.
With the legislature now adjourned, both HB 1549 and SB 3003 are dead — a temporary win for free expression and access to sexual health in the Lone Star State.
