AUSTIN, TX — (July 18, 2025) — Texas has resumed its lawsuit against Aylo, the parent company of Pornhub, following a landmark 6-3 U.S. Supreme Court ruling that upholds the state’s age-verification law for adult websites.

In an opinion authored by Justice Clarence Thomas, the Court ruled that the Texas law requiring adult sites to verify a user’s age does not violate the First Amendment, giving states the authority to enforce such protections to restrict access by minors.
“The power to require age verification is within a State’s authority to prevent children from accessing sexually explicit content,” wrote Justice Thomas in the majority opinion.
The 2023 Texas law mandates that pornographic websites verify that users are 18 or older and display a warning claiming that porn is “biologically addictive” and linked to harm in brain development and behavior—claims widely rejected by the scientific community.
The Free Speech Coalition had previously challenged this law in FSC v. Paxton, arguing it imposed unconstitutional burdens on adult platforms. But the high court’s decision last month upheld the age-check portion of the law while striking down the controversial health warning mandate.
Legal Battle Reignites
In response to the Supreme Court’s ruling, Texas Attorney General Ken Paxton has officially resumed his lawsuit against Aylo, first filed in February 2024. The suit alleges that Aylo’s platforms—Pornhub, YouPorn, and others—failed to comply with Texas’ legal requirements before choosing to block access to residents in the state altogether.
Paxton has also targeted other adult platforms, including the parent companies of Chaturbate and XHamster, in similar lawsuits.
Aylo successfully paused proceedings in July 2024, pending the SCOTUS outcome. With the court now siding with Texas, the case is back in motion.
According to Bloomberg Law, Aylo’s legal team is weighing its next steps. “Everyone’s reevaluating the new landscape after the Supreme Court opinion,” said attorney Scott Cole of Reichman Jorgensen Lehman & Feldberg, who represents Aylo.
The company now faces a key decision—either implement age verification in Texas or continue to block its sites statewide, as it has done in multiple jurisdictions across the U.S.
