NEW YORK, NY — (July 1, 2025) — As the jury in Sean “Diddy” Combs’ federal criminal trial reaches a partial verdict, the big question looms: What happens if they remain deadlocked on Count 1 — racketeering conspiracy?

So far, jurors have reached a decision on four of five charges, but are reportedly unable to agree on the racketeering count — the most sweeping and severe allegation in the indictment. If that stalemate continues, the court may be forced to declare a mistrial on Count 1, triggering serious consequences for the prosecution and defense alike.
A Hung Jury on Racketeering? Here’s What It Means:
If the jury fails to reach a unanimous verdict on Count 1, the judge may:

Allow prosecutors to retry Count 1 in a separate trial

Weigh whether to drop the charge altogether depending on outcomes of the other four counts
“Racketeering is often the spine of a federal indictment,” one legal analyst told JRL CHARTS. “If the jury is hung there, it weakens the structure of the case — even if they convict on other counts.”
Why Racketeering Matters in the Diddy Case
Racketeering conspiracy implies that Combs led or coordinated a criminal enterprise. It’s the glue connecting the sex trafficking and prostitution transport charges. If that charge falls apart, defense attorneys could argue that the case is more about individual incidents than an organized operation.
Prosecutors, however, will still celebrate any guilty verdicts on the other counts — especially those related to human trafficking.
