WASHINGTON, D.C. — (July 26, 2017) — The U.S. Department of Justice, led by Attorney General Jeff Sessions, is preparing to file a legal brief with the conservative-leaning 2nd Circuit Court of Appeals, arguing that Title VII of the Civil Rights Act of 1964 does not protect workers from discrimination based on sexual orientation. The anticipated filing has alarmed LGBTQ civil rights advocates, who view the move as a direct challenge to federal workplace protections for gay and lesbian Americans.

Director of the American Civil Liberties Union’s Lesbian Gay Bisexual Transgender & HIV Project, James Esseks said…that the Justice Department making a move such as this “would be a gratuitous and extraordinary attack on LGBT people’s civil rights. DOJ would be reaching out to offer its opinion on these issues, since they are not a party to this case. Fortunately,” Esseks told BuzzFeed News, “whether the Civil Rights Act protects LGBT people is ultimately a question for the courts to resolve, and not for the Attorney General.” said Esseks.
Legal director of the National Center for Lesbian Rights, Shannon Minter, downplayed the Justice Department’s publicity stunt against gay rights in the case, “because any such shift would inevitably be viewed as political and, as such, would likely be given little if any weight by the courts.” said Minter.
